Political Resident, and shall be composed of not more than three and notless than two members nominated by the Political Resident from among thefollowing: -
The Political Resident.The Assistant Judges of the Chief Court.The Judges of the High Court of Kenya.The Judges of the High Court of Cyprus.Members of the Bar of England, Scotland or Northern Ireland of notless than nine years' standing.
(iii) No person shall be precluded from hearing any case as a member ofthe Full Court composed of three members by reason of the fact that hehas already heard the case in the Consular Court or in the Chief Court.
(iv) Unless the Political Resident is sitting as a member of the Full Court,the senior member of the Court shall preside. In the case of a difference ofopinion in the Full Court of three members, the decision shall be in accordance with the decision of the majority. In case of a difference of opinion inthe Full Court of two members in a civil case, the decision under appeal shallstand, and in a criminal case the view most favourable to the accused shallprevail.
(6) The Chief Court and the Consular Court shall have a seal bearing thestyle of the Court and such device as the Secretary of State approves. TheFull Court shall use the seal of the Chief Court. Where the seal prescribedin this paragraph is not provided the seal of the Political Resident or of theConsul, as the case may require, may be used.
16.-(1) There may be attached to the Chief Court a Registrar, a Marshaland such other officers under such designation as the Political Resident, withthe approval of the Secretary of State, thinks fit, and every officer thusattached shall discharge such duties in connection with the Court and withthe Full Court as the Judge of the Chief Court may direct, subject to anydirections of the Secretary of State.
(2) The Registrar of the Chief Court shall be appointed by the Secretaryof State and the other officers by the Political Resident.
(3) There may be attached to the Consular Court a Registrar, a Marshaland such other officers under such designation as the Political Resident, withthe approval of the Secretary of State, thinks fit.
(4) The Registrar of the Consular Court shall be appointed by the PoliticalResident and the other officers shall be appointed by the Consul with theapproval of the Political Resident.
17. An up-to-date list of the names of all judges and officers of the ConsularCourt and the Chief Court together with the dates of their appointmentsshall be kept displayed in the offices of the Court.
18.(1) The Registrar of the Consular Court shall, subject to any directions of the Judge of the Chief Court(a) hold preliminary examinations (committal proceedings) in criminal
matters;(6) hear and determine such criminal cases as may be assigned to himby the Judge of the Consular Court, provided that any case whichis punishable by imprisonment for more than three years shall not be soassigned and the Registrar shall not inflict a sentence exceeding imprisonment for six months or a fine of 1,000 rupees or both.
